Very often our clients are current or former employees – i.e., company insiders – that have witnessed or learned about fraud being committed by their employers against the federal or state governments. Indeed, such fraud is particularly rampant in the pharmaceutical industry where unscrupulous members of Big Pharma routinely seek to increase their profits by unlawfully marketing drugs or medical devices to increase sales. Such unlawful marketing can take many forms, but the most common are “kickbacks” (financial incentives) paid to doctors to cause them to prescribe a particular drug or use a medical device; and “off-label” marketing, whereby the rogue company promotes its drug or device for medical uses that have not been approved by the FDA. Significantly, if the government pays for the unlawfully-marketed drug or medical device – e.g., via Medicare or Medicaid – then false claims for payment likely have occurred for which the drug company or medical device company is accountable under the federal False Claims Act, 31 U.S.C. § 3729, et seq., and under similar state laws.
